In consideration of the Employee undertaking Employment by HOTEL ST. MICHEAL CANADA shall pay and employed or Employee as follows


COUNTRY: - TORONTO, ONTARIO, CANADA.


STATUS: - BOTH SINGLE & FAMILY

BASIC SALARY: - IN UNITED STATE DOLLARS)


RESUMPTION DATE: - UPON ARRIVAL IN CANADA


2. OBLIGATIONS


Shall render expert Services with due skill and proper care, maintaining the highest professional standard at all times will perform such Prescribed Duties and Services at the company’s premises or other locations as agreed to between himself and the company shall render his service during the official Work hours acceptable to the Company in line with accepted working practices, which is PRESENTLY 8 HOURS OF WORKING ON MONDAY THROUGH SATURDAY and with observance of prescribed holidays. Agrees not to copy or transfer any data or information without permission from the company.


     


3. CONFIDENTIALITY

The Employee shall not during the operation of this Agreement or thereafter use for his own benefit or for the benefit of any other person or divulge or communicate to any person except to those officials of the Company province it, the secrets of the Company or the client or any other information which he may receive or obtain in relation to the Company’s or the Client’s affairs or those of its customers or of the data bases, internet access .or any tools or techniques which is carried on or used by the Company or the client. The consultant shall further co-operate with the Company, its client and any other persons the Company or the client may designate to obtain such security clearance as required.


4. RENEWAL/TERMINATION


It is agreed that HOTEL ST. MICHEAL CANADA can renew this contract at the end of TWO YEARS on mutually agreed terms. It is also agreed that either party can terminate this contract with 3 MONTHS NOTICE on either side.

5. OTHER INTERESTS

You must devote your full time, attention and abilities to your job duties during working hours, and to act in the best interests of the Company at all times. You must not, without Company’s written consent, be in any way directly or indirectly engaged or concerned in any other business where this is or is likely to be in conflict with the Company's interests (or those of its clients) or where this may adversely affect the efficient discharge of your duties.


6. ANNUAL LEAVE:-You are entitled to an annual leave of 45 days.


7. PLACE OF WORK

You will be employed in HOTEL ST. MICHEAL CANADA organization

and the organization may at any time require you to work at any other location of the Company or of any client to which the Company is providing services according to the business needs.


8. SECONDMENT/ PROJECTS

the Company reserves the right to second you from time to time. No such secondment shall result in a reduction in your pay or any other material deterioration in your terms of employment.


9. TRAVEL

You may be required to travel in the CANADA and outside CANADA from time to time. This may involve traveling normal business hours and at weekends or public holidays should the need arise.


10. DURATION OF CONTRACT: TWO YEARS CONTRACT–RENEWABLE.



               ALLOWANCES/

               ENTITLEMENTS:


a) ACCOMMODATION: FREE FURNISHED.

b) ANNUAL LEAVE: 45 DAYS PAID LEAVE.

c) LEAVE ALLOWANCE:----------$US DOLLARS.

d) AIR TICKET: BUSINESS CLASS (COVERS FAMILY).

e) PERSONAL LIFE AND ACCIDENT INSURANCE: FIRST CLASS (COVERS FAMILY).

i) MEDICAL TREATMENT: FREE (COVERS FAMILY).

j) HOUSE & FURNISHINGS:-----------$US DOLLARS) YEARLY.

k) CHILDREN’S EDUCATION ASSISTANCE: COVERS 100% EDUCATIONAL BILL.


l) TRANSPORTATION: PROVIDE PERSONAL CAR.

m) CAR MAINTENANCE:--------------$US DOLLARS MONTHLY.

n) TELEPHONE ALLOWANCE: COVERS 100% TELEPHONE BILL.



   11. ADDITIONAL SERVICES

Recreational/Sports Facilities shall also be made available at the disposal of all expatriates with no expenses to be incurred. Laundry and Dry Cleaning Service will also be made available to all Expatriates by the company's laundry and dry cleaning unit.


12. FLIGHTS/ HEALTH CARD/ GRATUITY

The Company shall provide a ONE-WAY AIR TICKET to the Employee at the termination of this Employment Contract to repatriate the Employee to his place of origin. The Company shall provide at least once a year during the term of Employment a return air ticket to the Employee to his place of origin.

The Company will provide you with a HEALTH CARD IN CANADA. You will be entitled to a gratuity in accordance with applicable CANADIAN labour laws from time to time. For the avoidance of doubt, in calculating any gratuity, any allowance will be disregarded.


13. WORKING HOURS

Normal hours of working will be in accordance with the agreement terms and conditions are 8 HOURS FROM MONDAY TO SATURDAY, or if other than shift time work will be 8 HOURS NIGHT SHIFT WORKING AND 8 HOURS DAYTIME SHIFT OR PART-TIME WORK hours per day as agreed and an applicant have to make choice of his or her Shift Working Schedule together with such additional hours as the Company may request or as may be necessary for the proper Performance of your duties. The Company may vary the normal start or finish times according to business needs. Overtime payments are made.


14. HOLIDAYS

The Employee is entitled to paid annual vacation of FORTY-FIVE (45) DAYS. The annual vacation period shall be calculated pro rata for any period of less than a year provided the Employee has completed at least one year of service. Holidays can only be taken at times agreed in advance with the Company. Any entitlement to holiday remaining at the end of any holiday year will lapse, unless specifically approved in writing by the Department head.


15. SICKNESS

You will be eligible to Sick Leave as per the CANADIAN Labour laws. Provided sickness certificates to be submitted to the company.


16. TERMINATION

A limited Contract shall be terminated on the provision by either of the Company or the Employee of NINETY (90) DAYS notice in writing to the other. The Company may make a payment of your basic salary in lieu of the above notice entitlement. On termination of your employment you must immediately return to the Company, in accordance with any instructions which may be given to you, all items of property belonging to the Company or to its clients in your possession or under your control. You must, if so required by the Company, confirm in writing that you have complied with your obligations under this provision.


17. RENEWAL

A limited Contract will be renewed automatically should the Employee continue the Employment after the expiry date set out above where the Company does not otherwise object and unless either the Company or the Employee has given written notification to the other at least NINETY (90) DAYS prior to the expiry date declining to Renew the Employment. Any employment under a Limited Contract renewed under this Clause 16 shall be deemed to be an Unlimited Contract for any period of renewal.


18. SAFETY & SECURITY

Safety and Security of personnel (Local/Foreign) and Facilities on Off-shore/On-shore and communities have been seriously considered to ensure and assure hitch free operations. All operations on Job Location are designed to adhere strictly to the Health Safety and Environment EMPLOYMENT AND SOCIAL DEVELOPMENT CANADA (ESDC) Policy as applicable in the Company. All expatriates are entitled to a free and mandatory safety courses on Job Locations to be delivered by qualified safety and environment experts. But must be used in accordance with the safety regulations in the company.



19. AGREEMENT FOR UPFRONT PAYMENT OF SALARY

TWO (2) MONTHS SALARIES shall be paid in advance to the employee upon completion of VISA processing application to assume duty upon arrived in Canada. This is to help you handle miscellaneous unanticipated costs as such no excuses will be entertained on assumption of duty relating to default.

Employee (Expatriates) are to note that TWO (2) MONTH’S SALARIES are to be paid as soon as Employee have furnish us with Copy of the CANADA WORK VISA processed here in CANADA and upon arrival in CANADA by the agreed agent through the office of Ministry of Interior as this is in line with the CANADA Expatriate Financial Statutory Laws.


20. OTHER DOCUMENTS RELEVANT TO YOUR EMPLOYMENT

The documents may be modified or replaced from time to time, you will be provided with particulars of any modification or a copy of any replacement. Your signature below will constitute your agreement to the terms set out herein.


21. RESIDENCE / WORK PERMIT DOCUMENTS PROCESSING Any employee successfully screened and recruited to resume employment the HOTEL ST. MICHEAL CANADA (And not presently possessing a valid CANADA RESIDENCE AND WORK PERMITS CLEARANCE PAPERS) Shall be expected to Scan and send to us and also send to the CANADAIAN EMBASSY via E-mail a copy of his/her INTERNATIONAL PASSPORT AND A PASSPORT PHOTOGRAPH for the immediate processing, procurement and acquisition of their necessary permits clearance papers with the MINISTRY OF INTERIOR and shall be duly notified once their valid Residence and WORK PERMITS CLEARANCE PAPERS are completed.

Any Employee that accepts this offer will have to contact the IMMIGRATION SERVICE CONSULTANTS TO CANADA, and should bear all the expense for the processing, procurement and acquisition of their necessary permits clearance papers with the MINISTRY OF LABOUR and the HOTEL ST. MICHEAL CANADA will be reimbursing back the expense upon arrival in CANADA. Note

that all CANADA based employees' are to report personally to our office with identification materials for signing and collection of hard copy of their contract documents.

NB: Any employee, who does not have INTERNATIONAL PASSPORT, should notify us earlier to enable us arrange an CANADIAN EMERGENCY TRAVELLING DOCUMENTS for him/her.


22. CONTRACT UNDERSTANDING

In witness whereof, the parties declare that they have read and fully aware of all the terms and conditions of this contract and that they signed below in full bona-fide, hereby entered into contractual commitment and provision of this contract agreement based on the conduct of the parties herein through the period of the agreement, both parties may decide to extend the agreement in the future, where term of responsibilities and relationship will be better defined and expatriated.
